Lindsey Davis
Lindsey is the managing partner of the Minneapolis office where her practice is focused on complex insurance and reinsurance disputes, representing insurers in a wide range of coverage matters. She handles first-party property coverage disputes in a variety of contexts and has dealt extensively with issues relating to policy interpretation, the application of various coverage exclusions and policy endorsements, and allegations of bad faith. She currently represents insurers in lawsuits around the country involving labor depreciation on property insurance claims. Lindsey has also been involved in a number of liability insurance coverage matters, including general liability and employment practices-related coverage matters.
In addition to her experience with insurance coverage and reinsurance issues, Lindsey has extensive experience defending financial services firms in challenging, high stakes lawsuits involving multi-million dollar claims of negligence, breach of contract, breach of fiduciary duty, and violations of state and federal statutes. She currently represents quasi-government agency plaintiffs in litigation against numerous banks related to the manipulation of LIBOR, a benchmark interest rate.
Representative Matters
Insurance Coverage
Represented property insurer in time element measurement dispute (Sonstegard Foods Co. v. Wellington Underwriting, Inc., 2007 WL 2908129 (D. Minn. 2007)).
Represented insurer in a coverage dispute which confirmed that an insured cannot create insurance coverage through waiver or estoppel except in very limited circumstances (Minnesota Commercial Railway v. General Star Indemnity Co., 408 F.2d 1061 (8th Cir. 2005)).
Represented property insurer in successful defense of $10 million claim for coverage under an excess property policy.
Reinsurance
Represented leading participant in reinsurance dispute regarding settlement of multi-billion dollar claims arising out of the September 11 attack on the World Trade Center.
Financial Services
Represented a prominent U.S. bank in series of lawsuits concerning securities lending and 2007-08 financial crisis.
Antitrust
Counsel to Minnesota and Iowa businesses and consumers in the only two indirect purchaser antitrust lawsuits against Microsoft Corporation that went to trial. The Minnesota lawsuit settled after seven weeks of trial for $182 million. The Iowa lawsuit settled after three months of trial for $180 million. On behalf of the Plaintiff classes, responsible for supervising the administration of these two settlements.
