Zelle Attorneys to Present at PLRB 2025 Claims Conference
March 30, 2025Zelle attorneys, Bryant Green, Seth Jackson, Brandt Johnson, and Shannon O'Malley will present at the PLRB 2025 Claims Conference in Indianapolis, IN on March 30 - April 2, 2025.
Seth Jackson, a partner in Zelle’s Boston, MA office, will co-present “Tenant Improvements & Betterments in Commercial Cases” with Thomas Carstens (Crawford & Company) and Brad Groce (Crum & Forster).
The session is about the complexities and interplay relating to tenant improvements and betterments in commercial cases. During the session, we will analyze commercial property policies regarding tenant improvements and betterments, identify insurable interests of landlords and tenants, evaluate leases and insurance responsibility for coverage implications, and compare legal cases impacting loss adjustment.
The presentation will take place on March 31, 2025 from 1:30 pm - 3:00 pm (ET) and April 1, 2025, from 10:30 am - 12:00 pm (ET).
Bryant Green, a senior associate in Zelle’s Washington, DC office, will present “Demystifying Ensuing Loss Clauses” with Houston Estes (Crawford & Company), Rupa Patel (Thornton Tomasetti), and Zenon Perez Jimenez (Zurich North America).
One court described ensuing loss clauses as “self-contradictory gibberish.” These clauses, however, are critical to protecting insureds from sudden and accidental losses while excluding long-term preventable losses and reducing moral hazard. This presentation will demystify ensuing loss clauses and equip adjusters and claims professionals to quickly identify “ensuing loss” claims, develop effective adjustment strategies to investigate, resolve, and make sure insureds are paid for exactly what they are entitled—no more, no less.

Brandt Johnson, a partner in Zelle's Dallas, TX office, will present "Full of Hot Air or a Legitimate Hail or Wind Claim?" with Howard Altschule (Forensic Weather Consultants) and Annette Tarquinio (Engle Martin and Associates).
Active weather patterns, including during El Nino and La Nina years, has caused the frequency and severity of hail, wind, tornadoes, derechos, and hurricanes to increase in different parts of the country over the past several years, including in 2024. Hurricanes Helene and Milton caused major wind, storm surge, and flash flooding damage from parts of Florida up through parts of the mid-Atlantic states. With so many perils and the deluge of insurance claims, the need for reliable, site-specific weather information from knowledgeable and experienced experts has never been more important.
Attendees will learn about the different sources of weather information that are available on the internet and how they’re frequently not representative of what occurred at the property location. We will also discuss automated vendor hail and wind reports, their accuracy, and how they’ve come under more scrutiny with the courts.

Shannon O'Malley, a partner in Zelle's Dallas, TX office, will present "Don’t Get Nailed by Roofing Fraudsters!" with with Dan Parker (J.S. Held).
This engaging one-hour session will explore the primary types of roofing fraud: man-made or manufactured damage designed to mimic wind or hail impacts, misrepresentation of the date of loss, the use of fraudulent invoices or loss documentation, water intrusion, and the importance of accurate weather reports and data. This session will provide strong roofing information for insurance, legal and law enforcement professionals.
