Zelle Attorneys to Present at PLRB 2024 Central Regional Adjusters Conference

Zelle attorneys, Seth Jackson and Jessica Port, will present at the PLRB 2024 Central Regional Adjusters Conference  in St. Louis, MO on August 27 – 28, 2024.  

Seth Jackson, a partner in Zelle’s Boston, MA office, will co-present “Code Enforcement Coverage in Commercial Cases” with Brandon Davis (J.S. Held LLC), George Dickover (Selective Insurance), and Randy Ramsdell (Liberty Mutual Insurance).

The session will analyze the pitfalls and hurdles involved with code upgrade coverage. The presenters will identify key language in different commercial property policies which may need to be addressed, the applicable governmental entities which may need to be conferred with, and the applicable codes and statutes that may need to be reviewed. The presenters will look at the key coverage forms including “ordinance or law” and “increased costs of construction”. The class will also evaluate different types of governmental orders which may trigger code coverage such as written or verbal orders. Specifically, the presenters will review what courts have considered an “enforcement” and whether a statement or action by a town official is required.

The presentation will take place on August 27, 2024, from 10:30 am – 12:00 pm (CT) and August 28, 2024, from 3:30 pm – 5:00 pm (CT).

Jessica Port, a senior associate in Zelle’s Washington, DC office, will present “In Defense of the Insurance Adjuster: How to Navigate Written and Implied Duties.” Jessica will be joined in the presentation by Gene Strother (Adjust U).

This interactive class trains adjusters on how to defensively navigate the many ethical requirements of insurance adjusters. Attendees will learn to recognize the inherent conflict of loyalties in their career, and receive instruction on the claims-adjusting actions that are required and prohibited by various ethics codes, rules, and regulations. This instruction will then be applied through case studies, with full participation from the attendees.

The case studies are based upon real-life situations where courts scrutinized the actions of insurance adjusters during the claims handling process to determine whether the insurer acted in bad faith. Throughout, the presenters will identify “red flags” signaling potential bad faith scenarios and offer tips on avoiding and adjusting defensively against bad faith accusations.

The presentation will take place on August 27, 2024, from 3:00 pm - 4:30 pm (CT) and August 28, 2024, from 9:00 am - 10:30 am (CT).
