Shannon O’Malley and Steven Badger to Present at 2018 WIND Conference
January 19, 2018Shannon O’Malley and Steven Badger, partners in the Dallas office of Zelle, will present at the 2018 WIND Conference, which will be held January 14-19, 2018 in Orlando, Florida.
O’Malley will co-present on the topic “Math or Myth: Calculating Actual Cash & Replacement Cost Values after a Windstorm.” There are many issues that arise in the context of measuring actual cash value and replacement cost. This course will address some of the more prevalent issues raised in property claims arising, including a practical discussion as to what constitutes a replacement of “like kind and quality.” The session will also address valuation of replacement cost and actual cash value issues from outside forces such as an area-wide catastrophe affect the cost of labor and material. This course also will address certain issues such as (obsolescence) raised when stock, as opposed to real property, is damaged and submitted as part of the windstorm claim. The presenters will briefly discuss how the application of a policy’s coinsurance provision may be affected by the valuation of the loss at either an actual cash value or replacement cost basis. Joining O’Malley for the presentation will be Kristine Elkind of MDD Forensic Accountants, Jonathan Held of J.S. Held, Kenneth Ritter of Quantum Global Advisors, and Arnold Mascali of Procor Solutions & Consulting.
Badger will be joined by Chip Merlin of Merlin Law Group to once again present their popular “Merlin vs. Badger: The Great Debate Sequel.” Merlin and Badger – a plaintiff attorney and insurance industry attorney – are well versed in all first party claims handling issues and in litigating disputed claims. This presentation will be a 1 hour 45 minute long discussion and debate on current developments and issues in the claims handling, appraisal, and litigation process for weather related claims.
