Jason Reeves to Present at Power and Utilities Business Interruption Insurance Roundtable
December 3, 2013On Tuesday, December 3, 2013, Jason Reeves, of Zelle Hofmann’s London office, will present a roundtable on the topic of “Power and Utilities Business Interruption Insurance.” The roundtable, which will be co-hosted by the law firms of Thomas Cooper and Zelle Hofmann.
The roundtable will be chaired by Ben Browne of Thomas Cooper. Joining Reeves for the roundtable will be Celso de Azevedo, also of Thomas Cooper.
The roundtable will review the New LMA Power and Utilities forms, LMA3109 (other than USA) and LMA 3110 (USA), drawing from a hypothetical hurricane loss in the east coast of the U.S., in order to examine:
- Coverage issues arising from the Indemnity Period, Civil Authority and Gross Earnings clauses in the LMA3109 and LMA 3110 forms.
- Other issues arising from the new LMA3109 and LMA 3110 forms.
- The impact on the measurement of indemnity by the business interruption insurance case of Orient Express Hotels Limited v A. Generali SpA (UK) (2010). The treatment in the UK and US courts of wide area damage clauses.
The recommendations in the recent Report on BI Policy Wordings published by the Insurance Institute of London in November 2012 as regards wide area damage losses.
