Steven Badger Quoted in SE Texas Record Regarding TX Mass Storm Litigation
March 27, 2017Steven Badger, a partner in the Dallas office of Zelle, was quoted in an article titled “Hail attorneys sued for suing wrong adjuster, twice – expert calls it the ‘sue now investigate never’ approach” that was published on the SE Texas Record website.
Since 2012, hundreds to thousands of lawsuits are filed after every hailstorm strike within the state of Texas, naming countless insurers, agents and adjusters as defendants.
Two of those suits mistakenly named an insurance agent with no connection to the men who sued her – a “malicious” action that has damaged her and her husband’s “spotless record” and put their careers “in jeopardy,” according to a recent lawsuit.
Alleging she was wrongfully sued, Jane Doe and her husband John Doe filed suit against Arguello Hope & Associates, along with several of the firm’s attorneys, and Schavon Jahn and Albert Zavala, the men who sued Jane, on March 13 in Comal County.
Badger, who is leading the Texas insurance industry’s response to mass storm litigation, says the Does’ lawsuit illustrates the commonplace failure of hail attorneys to conduct an investigation before filing suit.
